Terms & Conditions
Last updated: October 2026
The rules for using the RAW member portal, on the web and in the RAW app, and for enrolling in The Fortitude Program™.
General Terms
About These Terms
These Terms & Conditions ("Terms") govern your access to and use of the members-only client portal operated by RAW Recovery LLC ("RAW," "we," "us," or "our"). The portal is available on the web at clients.emotionalfortitude.com and through the RAW app, our Kajabi-branded mobile app (together, the "Portal"). The Portal is separate from our public websites. It is a gated environment for people who have created an account and are enrolled in a RAW program.
By creating an account, completing enrollment, or accessing any part of the Portal, you agree to these Terms in full. If you do not agree, do not create an account or access the Portal. These Terms apply alongside any program-specific agreement you sign separately. If the two conflict, the more specific document controls.
Acceptance of Terms
Your electronic acceptance, including clicking an "I agree" or "Enroll" button, completing checkout, or accessing the Portal after receiving login credentials, forms a legally binding agreement between you and RAW Recovery LLC. You confirm that you have the legal authority to enter this agreement on your own behalf.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and post the revised Terms in the Portal. For material changes, we will email the address on your account at least fourteen (14) days before the changes take effect. If you keep using the Portal after that date, you accept the updated Terms. If you disagree with a change, your remedy is to withdraw from your program before the change takes effect, as described in Section 6.
Eligibility
To use the Portal, you must:
- Be at least 18 years old;
- Be legally able to enter a binding contract;
- Be currently enrolled in The Fortitude Program™ or another RAW program;
- Provide accurate, complete, and current account information; and
- Not have been previously suspended or removed from the Portal for cause.
Your account is for you alone. You may not share your login credentials, enroll on behalf of another person, or let anyone else use your account.
Important Disclaimers
Please read this section carefully. It explains what RAW is and is not. If any of these disclaimers are unacceptable to you, do not enroll.
Not Therapy or a Mental Health Service
RAW Recovery LLC provides recovery coaching, performance coaching, and educational training. RAW is not a licensed mental health agency, clinical treatment facility, or medical provider. Nothing in the Portal, including courses, written content, live sessions, community forum discussions, or any communication from a RAW coach, is psychotherapy, clinical counseling, psychiatric treatment, medical advice, or any other licensed professional service regulated under California Business and Professions Code §2903 or any similar law.
If you are in crisis
If you are having a mental health emergency, a substance use crisis, or thoughts of suicide, call or text the 988 Suicide & Crisis Lifeline (988), call 911, or go to your nearest emergency room. RAW coaching is not a substitute for emergency services or professional mental health treatment.
Coaches as Independent Contractors
Coaches, facilitators, and other providers who deliver content or sessions through the Portal may be independent contractors rather than employees or agents of RAW. RAW makes reasonable efforts to vet and train the coaches it engages, but does not guarantee any particular outcome from their coaching and is not responsible for their independent professional judgments or actions outside the scope of their work with RAW.
No Guarantee of Outcomes
Testimonials, case studies, and examples shared in the Portal reflect individual experiences. They are not a promise that you will get similar results. Recovery and personal development vary widely from person to person, and your outcomes depend on many factors outside RAW's control, including your history, effort, consistency, and circumstances. RAW makes no warranty, express or implied, that any program, course, or session will produce a particular result.
Stage of Recovery
RAW programs are designed for men in a stable phase of recovery who are committed to growth-oriented work. They are not designed as primary treatment for active addiction or acute withdrawal. If you are in the early, unstable stages of recovery, we strongly encourage you to engage with clinical treatment first. We may defer or decline an enrollment when, in our professional judgment, our programs are not the right fit for someone's current situation.
Portal & App Access
Account Creation
The Portal runs on the Kajabi platform, both on the web and in the RAW app. To create an account, you must provide a valid email address, create a password, and complete the enrollment or checkout process for your program. You confirm that the information you provide is accurate and that you will keep it current.
Account Security
You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to:
- Use a strong, unique password for your Portal account;
- Tell us right away at melissa@emotionalfortitude.com or thomas@emotionalfortitude.com if you suspect someone else has accessed your account;
- Never share your login credentials with anyone, for any reason; and
- Log out at the end of each session on shared or public devices.
RAW is not liable for loss or damage caused by your failure to follow these security obligations. We may disable any account if we have reason to believe its credentials have been shared or its security has been compromised.
One Account Per Person
Each enrollment is issued to one person. Creating multiple accounts, using another member's credentials, or letting others use your account is a material breach of these Terms and may result in immediate removal from the Portal without a refund.
The RAW App
The RAW app is distributed through the Apple App Store and Google Play. Your download and use of the app is also subject to the terms of the store you use. Apple and Google are not parties to these Terms and are not responsible for the Portal or its content.
The Fortitude Program™
Program Description
The Fortitude Program™ is a structured 12-week coaching program for men in recovery and men committed to their own development. It includes scheduled live group sessions, including Fortitude Circle sessions; support from an assigned coach; course materials and members-only content in the Portal; direct messaging with your coach; and participation in the community forum with fellow members. Coach messaging and the community forum are available in the RAW app and in the web version of the Portal.
Program dates, session schedules, and specific content are shared at enrollment. We make every reasonable effort to deliver the program as described, but we may adjust scheduling, content, or facilitation when reasonably necessary to serve the group.
What Portal Access Includes
During your program, Portal access may include:
- Members-only courses and curriculum modules;
- Workbooks, field guides, and other supplementary materials;
- Members-only video and audio content, including session replays;
- Live group sessions on Zoom and coach support included in your program;
- Direct messaging with your coach, in the RAW app or on the web;
- The community forum, on the web and in the RAW app; and
- Any additional benefits described in your enrollment materials.
We may update, add to, or retire Portal content at any time. We will give reasonable notice before removing material content that affects members currently enrolled.
Digital Content License
Portal content is licensed to you, not sold. You receive a limited, personal, non-transferable license to access and view Portal content for your own non-commercial use while your enrollment is active. This license does not give you ownership of any content and does not permit downloading, copying, redistributing, or commercial use of any materials, except where RAW expressly provides a download.
When Your Program Ends
Your Portal access, including courses, session replays, community forum participation, and downloadable materials, continues through the end of your 12-week program period. After that, access ends unless RAW offers you continued access in writing. There is no automatic renewal and no recurring charge after your program fee is paid.
We encourage you to save any personal notes or materials you have created before your access ends. You may not be able to retrieve them afterward.
Missed Sessions
Live sessions run on scheduled dates and are not individually refundable if missed. Where possible, sessions are recorded and made available in the Portal for enrolled members to watch afterward. Attendance expectations are shared at the start of each program.
Fees, Payment Plans & Refunds
Program Fee
The fee for The Fortitude Program™ is $3,000.00 USD. You may pay it in one of two ways:
| Option | Amount | When You're Charged |
|---|---|---|
| Pay in full | $3,000.00 | Once, at enrollment |
| Three-payment plan | 3 Ă— $1,000.00 | The first payment at enrollment, then on the same calendar day in each of the following two months |
The payment plan is available for members who need it and does not change the total program fee. By choosing the payment plan, you authorize RAW, through its payment processor, to charge your payment method on file $1,000.00 at enrollment and on each of the two scheduled dates that follow, unless your enrollment ends earlier as described in Section 6.
Payment Processing
RAW processes payments through Kajabi or Stripe, depending on how you enroll:
| Processor | Used For | Terms |
|---|---|---|
| Kajabi | Enrollments and payment plans processed through the Portal checkout | kajabi.com/policies/terms |
| Stripe | Select enrollments and invoiced payments processed through Stripe checkout | stripe.com/legal/ssa |
The processor that applies to your enrollment is shown at checkout. By submitting payment, you also agree to that processor's terms and privacy policy. Your full card details are handled by Kajabi or Stripe and are not stored on RAW's own systems.
14-Day Refund Window
RAW offers a full refund of all payments made toward The Fortitude Program™ if you request it within 14 calendar days of your enrollment date and you have not yet attended any live session. This applies whether you paid in full or chose the payment plan. If you are on the payment plan, an approved refund also cancels any remaining payments.
To request a refund, email melissa@emotionalfortitude.com or thomas@emotionalfortitude.com within the 14-day window with your name, enrollment date, and the email address on your account. Approved refunds are issued to your original payment method within 10 business days.
After the 14-day window, or once you have attended a live session, payments already made are non-refundable.
Other Portal Products
Standalone courses and other digital products sold through the Portal are non-refundable once accessed, unless the checkout terms for that product say otherwise.
Failed Payments
If a scheduled payment fails, our payment processor may try the charge again. While a payment is outstanding, your Portal access may be suspended. If the payment is not resolved, RAW may end your enrollment. If that happens, any remaining payments are canceled, payments already made are non-refundable, and your access ends.
Taxes
Fees are quoted in U.S. dollars. You are responsible for any sales tax or similar tax that applies to your purchase. Where required by law, applicable taxes are calculated and added at checkout.
Withdrawal, Suspension & Termination
Withdrawing From the Program
You may withdraw from The Fortitude Program™ at any time by emailing melissa@emotionalfortitude.com or thomas@emotionalfortitude.com.
- If you paid in full: refunds follow the 14-day refund window in Section 5. After that window, no refund is issued for the remainder of the program.
- If you are on the payment plan: when you withdraw, any payments not yet charged are canceled and you will not owe them. Payments already made are non-refundable outside the 14-day refund window. To stop your next payment, your withdrawal notice must reach us at least 24 hours before that payment's scheduled date.
Your Portal access ends when your withdrawal is processed.
Suspension or Removal by RAW
We may suspend or end your Portal access, with or without notice, for:
- A material breach of these Terms or any program agreement;
- Conduct in the community forum or in live sessions that, in our judgment, harms other members or the integrity of the program;
- Non-payment of fees when due;
- Providing false or misleading information when enrolling; or
- Any conduct that exposes RAW to legal liability or reputational harm.
If RAW removes you for cause, payments already made are not refunded and any remaining payment-plan payments are canceled. If RAW ends your enrollment for reasons that are not your fault, we will refund a fair, pro-rated share of the fees you have paid for the portion of the program you did not receive.
Community Forum
What the Community Forum Is
The Portal includes a members-only community forum, available on the web and in the RAW app. It is a private space for enrolled members to connect with one another and with RAW coaches between live sessions. It is not open to the public, and your forum access ends when your Portal access ends.
The community forum is a confidential space. What other members share there is offered in trust. By participating, you make a binding commitment to protect the privacy and dignity of every other member.
Member Confidentiality
The community forum contains personal disclosures and vulnerable sharing by your fellow members. You agree that:
- You will not screenshot, copy, record, photograph, or otherwise capture any content another member posts;
- You will not share, forward, or discuss another member's posts outside the forum, publicly or privately, whether identifiable or anonymized;
- A member's identity, participation in RAW programs, and what they share in the forum is confidential information that belongs to that member;
- You will treat what is shared as you would want your own most personal disclosures treated; and
- Breaking these confidentiality obligations is a material breach of these Terms, is grounds for immediate removal, and may expose you to legal liability.
Your Posts and RAW's License
You keep ownership of what you post in the community forum ("Member Content"). By posting, you grant RAW Recovery LLC a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and moderate your Member Content within the Portal for as long as it remains there. This license does not allow RAW to use your personal disclosures in marketing or public materials without your separate written consent, and RAW will not attach your name to anything shared publicly without your explicit permission.
Prohibited Content
You may not post content in the community forum that:
- Is unlawful, threatening, harassing, abusive, defamatory, or invades another person's privacy;
- Gives professional advice (legal, medical, financial, psychological, or therapeutic), whether or not you hold a license;
- Promotes, glorifies, or gives detailed instruction about substance use, self-harm, or dangerous conduct;
- Solicits, recruits, advertises, or promotes any outside product, service, business, or cause;
- Discloses another member's identity, participation, or posts without their express written consent;
- Contains sexually explicit, violent, or otherwise objectionable material; or
- Infringes anyone's copyright, trademark, or other intellectual property rights.
Forum Norms: Feelings, Not Stories
The community forum asks members to share from felt experience rather than long narratives about other people. Speak to what you feel, what you need, and what you are working with, rather than detailed accounts of family members, partners, employers, or others who have not agreed to be discussed. Coaches and moderators may redirect or remove posts that are mostly stories about others.
No Advice-Giving
Please do not give other members directive advice, diagnoses, or prescriptions. Peer support and reflection are welcome. Telling another member what they should do, what their problem is, or what treatment they need is not. This protects both of you.
Moderation
RAW moderates the community forum and may remove any content at any time, with or without notice, including content that violates these Terms or that we decide is not in keeping with the spirit and values of the community. Repeated or serious violations may lead to loss of forum access or removal from the Portal.
Intellectual Property
RAW's Intellectual Property
All content in the Portal, including curriculum, course videos, audio recordings, workbooks, field guides, frameworks, program names (including The Fortitude Program™), logos, graphics, written content, and coaching methods, is the property of RAW Recovery LLC or its licensed contributors. All rights are reserved. The Fortitude Program™ name is a trademark of RAW Recovery LLC and may not be used without written permission.
Prohibited Uses
Without RAW's prior written consent, you may not:
- Download, copy, reproduce, or store Portal content beyond what RAW expressly allows;
- Share or distribute Portal content to anyone who is not an enrolled member;
- Use Portal content to build competing products, services, or training programs;
- Adapt or create derivative works from RAW's curriculum, frameworks, or methods;
- Use Portal content in any public presentation, training, publication, or media; or
- Remove or alter any copyright, trademark, or other notice in Portal content.
Your Content
You own the original content you create and post, subject to the license in Section 7. By posting, you confirm that you have the right to grant that license and that your content does not infringe anyone else's rights.
Third-Party Platforms
RAW uses third-party platforms to deliver the Portal. Your use of them is also subject to their own terms and privacy policies, which RAW does not control. The platforms we currently use are:
| Platform | Role | Terms |
|---|---|---|
| Kajabi | Portal hosting on the web and in the RAW app, content delivery, coach messaging, community forum, member accounts, payments, and program email | kajabi.com/policies/terms |
| Stripe | Payment processing for select enrollments | stripe.com/legal/ssa |
| Zoom | Live group sessions and individual sessions | zoom.us/terms |
| Apple App Store & Google Play | Distribution of the RAW app | Store terms apply |
RAW is not responsible for outages, data loss, security incidents, or other problems caused by a third-party platform. If you do not agree to a platform's terms, please tell us. Refusing to use a required platform may limit your ability to take part in parts of the program.
Your Personal Information
Kajabi processes the information associated with your Portal account, including your name, email address, purchase history, content activity, and community forum activity, on RAW's behalf. How we handle your personal information is explained in the Member Portal Privacy Policy, and Kajabi's practices are described at kajabi.com/policies/privacy.
Session Recording
Sessions May Be Recorded
Live sessions held on Zoom may be recorded so that enrolled members can watch replays in the Portal. Recordings may include video, audio, and chat.
California all-party consent (Penal Code §632)
California law requires the consent of everyone in a confidential conversation before it is recorded. By enrolling in a RAW program that includes live sessions and joining a session, you consent to that session being recorded as described here. If you do not consent, you must tell RAW in writing before the session begins at melissa@emotionalfortitude.com or thomas@emotionalfortitude.com, and we will work with you to see whether an accommodation is possible. Joining a live session after being told it will be recorded is consent under applicable law.
Use of Recordings
Recordings are available to enrolled members in the Portal for personal, non-commercial review while their enrollment is active. They are covered by the same intellectual property terms as other Portal content. You may not download, share, distribute, or post recordings or any part of them, and you may not record sessions yourself on any device or software without the written consent of everyone present.
Other Members in Recordings
Recordings may capture the faces, voices, and disclosures of other members. The confidentiality obligations in Section 7 apply to recordings in the same way they apply to the community forum.
Limitation of Liability
Disclaimer of Warranties
THE PORTAL AND ALL CONTENT, SERVICES, COACHING, AND MATERIALS PROVIDED THROUGH IT ARE OFFERED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. RAW RECOVERY LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RAW DOES NOT WARRANT THAT THE PORTAL WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RAW RECOVERY LLC AND ITS MEMBERS, MANAGERS, COACHES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE PORTAL, INCLUDING LOSS OF PROFITS, LOSS OF DATA, EMOTIONAL DISTRESS, OR PERSONAL INJURY, EVEN IF RAW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. RAW'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THESE TERMS OR THE PORTAL WILL NOT EXCEED THE TOTAL FEES YOU PAID TO RAW IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain warranties or liabilities to be excluded or limited. In those places, these limits apply to the fullest extent the law allows.
Assumption of Risk
Personal development and recovery work involves real emotional challenge. Engaging with Portal content, exercises, and coaching may bring up difficult memories, feelings, or experiences. You take part voluntarily, accept the risks that come with this work, and agree that RAW is not liable for emotional distress, relapse, or other outcomes that may arise from your participation.
Indemnification
You agree to indemnify, defend, and hold harmless RAW Recovery LLC and its members, managers, coaches, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Portal; (b) your breach of these Terms; (c) your violation of any law; (d) content you post in the community forum; or (e) your infringement of anyone else's rights.
Dispute Resolution
Informal Resolution First
Before starting any formal proceeding, you and RAW agree to try in good faith to resolve the dispute informally. Email melissa@emotionalfortitude.com or thomas@emotionalfortitude.com describing the dispute in reasonable detail. RAW will respond within fifteen (15) business days. If the dispute is not resolved within thirty (30) days of your first notice, either party may proceed to binding arbitration.
Binding Arbitration
Any dispute arising out of or relating to these Terms, the Portal, or your enrollment that is not resolved informally will be settled by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures or its Comprehensive Arbitration Rules, as JAMS determines.
- The arbitration will take place in Orange County, California, unless both parties agree to another location or to remote proceedings;
- The arbitrator may award any remedy a court of competent jurisdiction could award;
- The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction;
- Filing and arbitration fees are allocated under JAMS rules, and each party pays its own attorneys' fees unless the law requires otherwise; and
- Discovery is limited to what is reasonably necessary and proportionate to the dispute.
Information about JAMS is available at jamsadr.com.
Class Action Waiver
You and RAW each waive the right to bring or join any class, collective, or representative action. All disputes must be brought individually. If this waiver is found unenforceable in a particular case, that case will be heard in court rather than arbitration, and the rest of these Terms will remain in effect.
Exceptions
Either party may ask a court for emergency or preliminary injunctive relief to prevent irreparable harm while arbitration is pending, including in cases involving unauthorized use of intellectual property. Either party may also bring a qualifying claim in small claims court.
Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. For any dispute not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Orange County, California.
General Provisions & Contact
Entire Agreement
These Terms, together with any program enrollment agreement, intake forms, or supplemental terms you have accepted for a RAW program, are the entire agreement between you and RAW Recovery LLC about the Portal and your enrollment. They replace all earlier understandings on those subjects. Statements made in sales conversations, webinars, or promotional materials that are not included in a written agreement or these Terms are not binding.
Severability
If any part of these Terms is found invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest will remain in full effect.
No Waiver
If RAW does not enforce a right or provision in one instance, that is not a waiver of it. A waiver is effective only in writing from an authorized representative of RAW.
Force Majeure
RAW is not liable for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, pandemics, government action, power or telecommunications failures, third-party platform outages, or civil unrest. In those cases, RAW will make reasonable efforts to resume normal service and will keep enrolled members informed about any material disruption to their program.
Assignment
You may not assign or transfer your rights or obligations under these Terms without RAW's written consent. RAW may assign these Terms in connection with a merger, acquisition, or sale of assets, provided the successor takes on RAW's obligations under them.
Notices
Notices from you to RAW must be sent by email to both melissa@emotionalfortitude.com and thomas@emotionalfortitude.com. Notices from RAW to you will be sent to the email address on your Portal account, so please keep it current. Email notices are considered received on the next business day after they are sent.
